Terms of Service (AGB)

§ 1 Scope and provider

These Terms of Service apply to the use of the Impulsly service on impulsly.com and via WhatsApp. The provider is Buuk Publishing GmbH & Co. KG, Hortensienstraße 26, 40474 Düsseldorf, Germany (“we”), email: info@buchbuddy.de. Impulsly is aimed at consumers.

§ 2 The service

Impulsly sends you short text impulses on topics you choose yourself, via WhatsApp – in your chosen rhythm and time window. The scope (number of selectable topics, maximum impulses per day) depends on the chosen plan and is displayed before purchase. A free basic offering with limited scope exists independently of paid plans.

The topic catalog evolves continuously; individual topics may be added, revised or discontinued. The contractually owed core scope (number of topics and impulses according to your plan) remains unaffected.

§ 3 Conclusion of contract

Registration happens without a password via a WhatsApp message; your account is tied to your phone number. The contract for a paid plan is concluded when you complete the payment process via our payment provider Stripe and we confirm the order or activate the plan. The contract language is German.

§ 4 Prices and payment

The prices displayed at the time of ordering apply, including applicable VAT. The billing currency depends on your country. Payment is processed via Stripe; billing occurs monthly or yearly in advance, depending on the chosen period.

§ 5 Term, renewal, cancellation, plan changes

Paid plans renew automatically for the chosen billing period (month or year) unless cancelled before expiry. You can cancel at any time effective at the end of the current billing period – directly in your settings via “Manage subscription” (Stripe customer portal) or by email to info@buchbuddy.de.

An upgrade to a higher plan takes effect immediately; amounts already paid are credited pro rata. A downgrade takes effect at the end of the current billing period.

§ 6 Right of withdrawal

Consumers have a statutory right of withdrawal. Details are set out in the withdrawal notice. Please note: if, at purchase, you expressly request that we start performing before the withdrawal period ends and we perform the service in full, the right of withdrawal expires; if you withdraw before full performance, you owe compensation for the part already performed.

§ 7 Gift access

After redemption, gift codes grant the recipient time-limited access to the stated scope; the period starts upon redemption and ends automatically – no subscription is created. A code can be redeemed once and cannot be exchanged for cash. After expiry, the recipient's first chosen topic continues in the free basic offering.

§ 8 Requirements and obligations

You need your own WhatsApp account; WhatsApp's terms apply in addition. You warrant that the phone number provided is yours. Impulsly must not be misused, in particular not to sign up third parties without their consent. Minors require the consent of their legal guardians.

§ 9 Availability

We strive for high availability but cannot guarantee uninterrupted service. Delivery happens via WhatsApp (Meta); disruptions in third-party networks and services are outside our control. Announced maintenance is scheduled, where possible, during low-usage times.

§ 10 Liability

We are liable without limitation for intent and gross negligence, for damage resulting from injury to life, body or health, and under the German Product Liability Act. In cases of simple negligence we are only liable for the breach of essential contractual obligations (obligations whose fulfillment makes the proper performance of the contract possible in the first place and on whose observance you may regularly rely), limited to the foreseeable damage typical for this type of contract. Any further liability is excluded.

§ 11 No advice

Impulses are loving nudges for your everyday life. They are not medical, psychological, legal or financial advice, not therapy, and no substitute for professional help. If you are seriously struggling, please reach out for professional support – in a crisis, for example, the 988 Suicide & Crisis Lifeline (US) or Samaritans 116 123 (UK).

§ 12 Changes to the service and these terms

We may amend these terms with effect for the future if there is a valid reason (e.g. changes in law, further development of the service) and the amendment is reasonable for you. We will notify you of changes at least six weeks before they take effect, via WhatsApp or email. If you do not object before the effective date, the amended terms apply; we will point out this consequence separately in the notification. Your right to cancel remains unaffected.

§ 13 Final provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of the state of your habitual residence remain unaffected. We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board. Should individual provisions of these terms be invalid, the remainder of the contract remains effective.
